Definition: Partition Referee Orange County

In Orange County California, a partition referee may appointed by the presiding judge of a case to partition real or personal property by sale or division. Parties to the partition action are often family members, business partnerships, or spouses. When one or more of the parties wish to sell their share of the property, a referee may be appointed to assist with its sale and division. The partition referee is responsible for the fulfillment of any court orders handed down by the judge.

The judge has sole discretion to appoint a partition referee. As a neutral third party, the partition referee’s function is to fulfill the orders of the court as determined by the judge. This includes the partition of the real and personal property involved in the case.

There are multiple references in the Code of Civil Procedure that reference appointing a referee to assist in the division and sale of properties as ordered by the court. In all cases, the presiding judge must use his discretion to interpret whether or not the particular case warrants the appointment of a partition referee.

According to CCP 873.010 (a), “The court shall appoint a referee to divide or sell the property as ordered by the court.” CCP 873.210 allows a referee to be “appointed through an interlocutory judgment.” And CCP 873.060, states that, if appointed by the court, a partition referee may “perform any acts necessary to exercise the authority conferred by this title or by order of this court.”

The primary focus of the partition referee is to maximize the selling price of real property that is sold via the partition process.

Inherent to all real and personal property owners is the legal right to divide and sell a property to protect and capitalize their interest. When one or more owners of real or personal property want to either sell the property or sell their interest in the property, a partition action can be brought to protect their rights from the other owners who do not want to sell.

A partition action is a lawsuit filed by one or more of the owners of real or personal property in order to obtain a court judgement to divide or sell the property. It should be noted, the right to a partition may be waived by a contractual agreement.
